STAY IN THE BAY First and foremost, the Design Review & Covenants Department is charged with the responsibility of enforcing and maintaining the following governing documents for Pelican Bay: • Second Amended and Restated Declaration and General Protective Covenants for Pelican Bay (Declaration) recorded in Official Records Book 4442, Page 3381, et. seq., of the public records of Collier County, Florida. • Amended and Restated Articles of Incorporation for Pelican Bay Foundation, Inc. formally known as Pelican Bay of Naples Foundation, Inc. (Articles) • Amended and Restated Bylaws of Pelican Bay Foundation, Inc. (Bylaws) recorded in Official Records Book 5222, Page 2343, et. seq., of the public records of Collier County, Florida. • Pelican Bay Foundation Rules and Regulations (Rules). An Owner should refer to the Pelican Bay website located at https://pelicanbay.org/ for a current copy of the Rules. • Pelican Bay Neighborhood Covenants and Restrictions (Neighborhood Covenants). An Owner should refer to the governing documents for the Neighborhood the Owner’s property is located within to obtain copies of the relevant Neighborhood Covenants. • Pelican Bay Planned Unit Development Ordinance Number 77-18 and Ordinance Number 04-59 (collectively, PUD). At the time of the purchase of your property (residential or commercial), you agreed to abide by all the governing documents for Pelican Bay. The purpose of these governing documents is to ensure each property owner — whether a single-family homeowner, a condominium unit owner, a villa owner, a community association or a commercial property owner — is in compliance with these governing documents. The Pelican Bay website is a good source for reviewing some of these documents and can be found there (www. pelicanbay.org) under the Members tab. We encourage you to take some time to look at these documents so that you are aware of what is required from you as an owner/member to avoid any notices of violations, potential fines or suspensions. In addition to enforcing the governing documents, the Design Review & Covenants Department is responsible for the review and approval of all exterior changes, including landscape changes, renovations, additions, upgrades, expansions, teardowns and rebuilds. As a member/owner, it is important for you to be aware of the design review approval process and the requirements in the event you desire to make any changes to the exterior of your home, property or building. All exterior projects (no matter how big or small) must be submitted in writing to the Foundation Design Review & Covenants Department, prior to the commencement of any work. Each owner/member should anticipate the timing of a project and submit the required application with plenty of time for review and re-reviews, if necessary. Remember, no work may commence until written approval from your neighborhood association and the Design Review & Covenants Department and/or the Design Review Committee. This review process provides verification that the proposed changes and/or improvements meet with Foundation and neighborhood governing documents, as well as the design guidelines for Pelican Bay. Applications are available on the Pelican Bay website or by calling the Design Review & Covenants Department. Projects that require approval from the Foundation, the DRC and/or your neighborhood association include the following: Minor Projects Minor projects include those that are minor in scope and duration (less than 15 days), like-for-like changes, replacements, etc. Typically, no design review fees are required for minor projects. Reviews will be completed within 14 working days of receipt of application. Applications require approval from the neighborhood association, landlord or owner (whatever the case may be).
